General conditions of the contract of sale of package tours (“General Conditions”)<\/span><\/h1>\n

  1. CONTENT OF THE TOURIST PACKAGE CONTRACT<\/span>\n
      \n
    1. By sending the proposal for the purchase of the tour package, the traveler confirms that he\/she has read and accepted these General Terms and Conditions, for him\/herself and for the parties for whom he\/she requests the services of the tour package.<\/li>\n
    2. The tourist package contract consists of these General Terms and Conditions and the travel information sheet applicable from time to time, which constitutes an integral and substantial part thereof.\n<\/li>\n<\/ol>\n<\/li>\n
    3. SOURCES<\/span> APPLICABLE REGULATIONS<\/span><\/span>\n
        \n
      1. The tourist package contract, both for services or services to be provided on the territory of the Italian Republic and for those to be provided abroad, is governed by Legislative Decree No. 79 of May 23, 2011 and ss.mm.ii. (“Tourism Code<\/span>“) – with particular reference to Articles 32 to 51-novies <\/i>and, if and insofar as applicable, by Law No. 1084 of December 27, 1977 of Ratification and Execution of the International Convention on the Travel Contract (CCV) signed in Brussels on April 23, 1970) and by Legislative Decree No. 2006 of 6.9.2005 (“Consumer Code<\/span>“) as well as, again insofar as applicable, by the provisions of the Civil Code also on the subject of transportation and mandate. \n<\/li>\n<\/ol>\n<\/li>\n
      2. DEFINITIONS<\/span>
        <\/span>\n
          \n
        1. OUTDOO S.R.L.<\/span>, a company under Italian law with registered office in Padua, Via S. Crispino, 106, Fiscal Code, VAT No. and registration with the Register of Companies of Padua No. 05719700287, share capital of EUR 10,000.00 is considered to be the “organizer” of the tourist package pursuant to and for the purposes of the Tourism Code and these General Conditions.<\/li>\n
        2. “Tourist package” means the combination of at least two different types of tourist services such as:\n
            \n
          1. transportation of passengers;<\/li>\n
          2. accommodation, which is not an integral part of passenger transportation and is not intended for residential purposes, or for long-term language courses;<\/li>\n
          3. The rental of cars, other motor vehicles pursuant to the Ministerial Decree of April 28, 2008, or motorcycles that require a category A driving license, pursuant to Legislative Decree No. 2 of January 16, 2013<\/li>\n
          4. any other tourist service that is not an integral part of one of the tourist services under (a), (b) and (c), and is not a financial or insurance service for the purpose of the same trip or vacation, if at least one of the following conditions is met: <\/li>\n
          5. such services are combined by a single professional, including at the request of the traveler or in accordance with a selection, before a single contract is concluded for all services;<\/li>\n
          6. such services, even if concluded under separate contracts with individual providers, are:<\/li>\n
          7. purchased at a single buying and selling point and selected before it traveler consents to payment;<\/li>\n
          8. offered, sold or invoiced at a flat or global price;<\/li>\n
          9. advertised or sold under the name “package” or similar name;<\/li>\n
          10. combined after the conclusion of a contract by which the professional allows the traveler to choose from a selection of different types of tourist services or purchased from separate professionals through related online booking processes where the traveler’s name, payment details and e-mail address are transmitted by the professional with whom 6 the first contract was concluded to one or more professionals and the contract with the latter professional(s) is concluded no later than 24 hours after the confirmation of the booking of the first tourist service.<\/li>\n<\/ol>\n<\/li>\n
          11. “Package tour contract<\/span>” or “contract<\/span>” or “travel contract<\/span>” means the contract relating to the entire package tour or, if the package tour is provided under separate contracts, the set of contracts relating to the tourist services included in the package tour.<\/li>\n
          12. “Traveler<\/span>” means any person who intends to enter into a contract, enters into a contract, or is authorized to travel under a contract concluded as part of a package tour contract.<\/li>\n
          13. “Professional<\/span>” means any public or private natural or legal person who, as part of his or her commercial, industrial, handicraft or professional activity acts, in contracts, including through another person acting in his or her name or on his or her behalf, as an organizer, seller, professional facilitator of related tourist services or provider of tourist services, within the meaning of the applicable regulations.<\/li>\n
          14. “Organizer<\/span>” means a professional who combines tour packages and sells or offers them for sale directly or through or together with another professional, or the professional who transmits traveler data to another professional.<\/li>\n
          15. “Seller<\/span>” means the professional other than the organizer who sells or offers for sale tour packages combined by an organizer.<\/li>\n
          16. “Durable medium<\/span>” means any instrument that enables the traveler or professional to store information that is personally addressed to him or her in such a way that it can be accessed in the future for a period of time appropriate to the purposes for which it is intended and that allows for identical reproduction of the stored information.<\/li>\n
          17. “Unavoidable and extraordinary circumstances<\/span>” means a situation beyond the control of the party invoking such a situation and whose consequences would not have been avoided by taking reasonable measures to prevent it.<\/li>\n
          18. “Conformity defect<\/span>” means a non-performance of the tourist services included in a package tour.<\/li>\n
          19. “Return<\/span>” means the return of the traveler to the place of departure or other place agreed upon by the contracting parties.<\/li>\n
          20. The “place of departure<\/span>” means the city from which the traveler independently took the first useful flight to reach the destination of the beginning of the tour package.<\/li>\n
          21. “Basic<\/span>reservation” means the reservation made without the choice of any additional options or services such as, but not limited to, transfers to\/from the airport, accommodation preferences, extra services, equipment rental, sports lessons, etc.<\/i><\/li>\n
          22. <\/i>“Travel information<\/span>sheet” or “fact<\/span>sheet” or “trip sheet<\/span>” means the data sheet related to the individual trip offered by Outdoo, in which the essential elements of the tour package are listed.<\/li>\n
          23. “Bookable trip<\/span>” means a trip that is planned but has not yet met the minimum requirements to confirm departure (e.g., because the minimum number of participants has not been reached.<\/li>\n
          24. “Confirmed<\/span>trip” means a trip that has met the minimum requirements and whose departure has been confirmed by Outdoo. Depending on the case, additional participants may still be added. \n

            Unless otherwise specified, the above definitions also apply to the travel information sheet.<\/p>\n<\/li>\n<\/ol>\n<\/li>\n

          25. MANDATORY INFORMATION AND DATA SHEET<\/span>\n

            1. Prior to the conclusion of the tourist package contract, Outdoo communicates to the traveler – clearly and precisely – through what is published in the catalog on the web pages related to the chosen destination, or through quotation or other information tool, the following information:\n
