1) Introduction

This Cookie Policy (“Policy“) describes what tracking technologies are used by Outdoo S.r.l. (“Outdoo” or “Owner“) when you interact with the website www.outdoo.it and with the various services offered by it (“Site“).

To enable the Site to function properly and improve your browsing experience, store your preferences, or track your online behavior, Outdoo uses certain trackers that allow us to access and/or store information about your device, including some of your personal data (“Trackers“).

The information contained in this Policy is provided pursuant to Art. 13 of Reg. (EU) 679/2016 (“GDPR“), Legislative Decree 196/2003 as amended (“Privacy Code“), and applicable national and/or EU regulatory provisions on the protection of personal data, as well as relevant interpretations on the point.

The information in this Policy relates only to processing carried out by Outdoo through the Site’s Trackers and does not extend to processing carried out by third parties that may be accessed through the links below. The data controller is OUTDOO S.R.L., a company under Italian law with registered office in Padua, Via S. Crispino, 106, Fiscal Code, VAT No. and registration with the Companies’ Register of Padua No. 05719700287 (“DataController“).

3) What are Trackers

The Site uses certain Trackers, including software development kits (“SDKs“), which use unique identifiers to access and/or store information about your device. SDKs are collections of software tools and libraries that allow Outdoo to integrate specific functionality into the Site. Depending on the case, some of these SDKs may install trackers such as cookies.

Cookies are small text files that sites visited by the user send to the device used to access the Internet (usually the browser), where they are stored and then transmitted back to the same sites on the next visit by the same user. Each cookie is unique in relation to the browser and device used to access the Site.

4) Personal data processed

Through Trackers, we collect and process data inherent in your browsing of the Site such as IP address, device identifiers, operating system details, characteristics of the device used, pages viewed, date of access to the Site, and preferences on Trackers.

5) Types of Trackers Used

The Site uses:

• First-party trackers: placed on your device by the Site;
• Third-party trackers: placed through the Site on your device by selected third parties .

In addition, based on the duration, Trackers can be distinguished into:

• Session trackers: are kept for the duration of the browsing session;
• Permanent trackers: are kept for a predefined period.

Tracers are generally distinguished according to the purpose:

• Technical Trackers: these Tracers are necessary for the operation of the Site, they include both Navigational Tracers (necessary for normal navigation and use of the Site) and Functionality Tracers (which allow us to remember your settings on the Site, such as your privacy preferences, in order to improve its services). The storage of these Trackers does not require your consent.
• Profiling Trackers: these Trackers are used to track your behavior in order to create a profile about your interests and send you personalized advertising messages that are in line with your preferences. We may also share this information with third parties. The storage of these Trackers requires your consent. You are free to give, withhold, or revoke your consent to the installation of these Trackers via the consent banner displayed on the Site and/or through the features of your operating system. Your preferences are recorded in a consent management platform (CMP) offered by Iubenda, which acts as our data controller. The functionality of the Site will not be affected in any way should you decide to deny consent to the installation of these Trackers.
• Analytical Trackers: these Trackers are used to collect information about your interactions with the Site in order to optimize its services. The storage of these Trackers does not require consent, when they are equated with technical.

You will be able to express your preferences on Trackers via the consent banner, which allows you to accept all Trackers, reject or express a granular preference with respect to Trackers that require your consent, such as Profiling Trackers.

The choices you make are retained for 12 months and are tracked within the Preferences Registry maintained by the Data Controller.

8) Your rights

At any time and free of charge, within the limits of the GDPR and the Privacy Code, you may exercise the following rights against the Controller:

• Right of access: you have the right to obtain confirmation from the Data Controller whether or not any processing of your personal data (or the existence of an automated decision-making process) is taking place, and if so, to obtain access to and/or copies of such personal data (Art. 15 GDPR).
• Right of rectification: you can obtain rectification or integration of your personal data that is inaccurate, partial and/or incomplete (Art. 16 GDPR).
• Right to erasure (so-called right to be forgotten): under certain circumstances, you have the right to have your personal data erased without undue delay (Art. 17 GDPR).
• Right to restrict processing: under certain circumstances, you may obtain restriction of processing(e.g., if you objected to the processing, if you exercised your right to rectification, and/or if the processing is unlawful). In case of restriction of processing, personal data will be processed, except for storage, only with your consent or for the establishment, exercise or defense of a right in court or to protect the rights of another natural or legal person or for reasons of important public interest. You will be informed, in each case, before such limitation is lifted. (Art. 18 GDPR).
• Right to data portability: you can, at any time, request and receive, all your personal data processed by the Data Controller in a structured, commonly used and readable format or request its transmission to another data controller without hindrance (Art. 20 GDPR).
• Right to object: you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you. If you object, the Data Controller will refrain from the processing to which you object, unless it can be shown that there are compelling legitimate grounds for processing that override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims (Art. 21 GDPR).

In addition, you have the right to lodge a complaint with the supervisory authority: without prejudice to your right of recourse to any other administrative or judicial forum, if you believe that the processing of your personal data is taking place in violation of the applicable legislation and/or that your rights have not been met, you may lodge a complaint with the Data Protection Authority or other competent supervisory authority.

9) Where your personal data will be processed

Your data may be transferred outside the European Economic Area (“EEA“) if this is necessary for the performance of the Contract, for example, because you will reach a non-European destination. In that case, the transfer will be in accordance with applicable law and the recipients of the data will be subject to similar protection and security obligations as we provide to you.
